The Tax Office has amended its previously released draft ruling concerning salary sacrifice arrangements (SSAs).
Importantly, the draft ruling now provides that SSAs entered into by employees governed by an industrial award, which reduce salary below award rates, are effective (acceptable). This is contrary to the previous draft ruling. In addition, the amended draft ruling provides that SSAs concerning bonuses or leave must be made before the employee earns the bonus or leave entitlement.
